Terms of Service

These Terms of Service (“Terms”) govern your access to and use of games, apps, websites, and related services provided by Keepit Games (“Keepit Games”, “we”, “us”, or “our”). By using our services, you agree to these Terms.

1. Acceptance of these Terms

By accessing or using any Keepit Games service (collectively, the “Services”), you confirm that you are at least the age of majority in your jurisdiction, or you have the consent of a parent or legal guardian. If you do not agree to these Terms, do not use the Services.

2. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting an update in-game or on our website). Continued use of the Services after changes become effective means you accept the updated Terms.

3. Accounts and Security

Some Services may require an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for activities under your account.

  • Do not share accounts or credentials unless we explicitly allow it.
  • Notify us promptly if you suspect unauthorized access to your account.

4. License and Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial entertainment purposes, subject to these Terms and any additional rules posted within a specific game or platform store.

5. User Conduct (Rules of Play)

You agree not to:

  • Cheat, exploit bugs, use unauthorized mods, bots, or automation that disrupts gameplay or fairness.
  • Reverse engineer, decompile, or attempt to extract source code except where prohibited by law.
  • Harass, threaten, or discriminate against others; or post hateful, violent, or sexually explicit content.
  • Use the Services to distribute malware, spam, phishing, or otherwise harmful content.
  • Interfere with servers, networks, or security features of the Services.

We may enforce these rules through warnings, suspensions, bans, content removal, or other actions as we consider appropriate.

6. User-Generated Content

Some Services allow you to create or share content (e.g., chat messages, usernames, avatars, levels, screenshots) (“User Content”). You retain ownership of your User Content, but you grant Keepit Games a worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (for technical purposes), publicly display, and distribute your User Content in connection with operating and promoting the Services.

You represent that you have the rights necessary to post User Content and that it does not violate any law or third-party rights.

7. Ownership and Intellectual Property

The Services, including all software, artwork, characters, trademarks, logos, and other content (“Keepit Content”) are owned by Keepit Games or its licensors and are protected by intellectual property laws. Except for the license granted above, we reserve all rights not expressly granted to you.

8. Purchases, Virtual Items, and Refunds

Some Services may offer paid content, subscriptions, or virtual items (“Virtual Items”). Prices and availability can change. Unless otherwise required by law or platform policy, purchases are final and non-refundable.

  • Platform purchases (Steam, Apple, Google, console stores) are governed by that platform’s payment and refund rules.
  • Virtual Items have no real-world monetary value and are not property; they are a limited license to access features/content.

9. Third-Party Services

The Services may integrate with or link to third-party services (e.g., platform accounts, analytics, payment processors). We are not responsible for third-party services and their terms and policies may apply.

10. Privacy

Our collection and use of personal information is described in our Privacy Policy.

11. Service Availability and Updates

We may modify, update, or discontinue any part of the Services at any time, including features, content, or servers. We do not guarantee that the Services will be available at all times or in all regions.

12. Suspension and Termination

We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or to protect the safety and integrity of the Services. You may stop using the Services at any time.

13. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEEPIT GAMES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEEPIT GAMES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEEPIT GAMES’ TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO KEEPIT GAMES FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $50 IF YOU PAID NOTHING, WHICHEVER IS GREATER.

15. Governing Law and Disputes

These Terms are governed by the laws of USA, state of Delaware, without regard to conflict-of-law rules. Any disputes will be resolved in the courts located in court of Delaware, unless applicable law requires otherwise.
